2个月前 麦琪: 学术性法学本科教育的硬伤 摘要：在中国法制化进程不断加快的今天的，法学教育也取得了较快的发展，但是由于教育本身存在的问题使法学本科教育的弊端也日益凸显，法学教育家们纷纷讨论对策，但只是针对出现的具体问题“头痛医头，脚痛医脚”。缺乏对问题背后原因的深层次分析。 本文首先通过对法学本科教育现状的描述展示出法学本科教育的问题，然后并不是忙于对这些问题进行具体分析，而是把视觉转移到法学本科教育本身上，通过多角度的分析指出目前法学本科教育的学术性倾向，并且分析论证了这种倾向自身有着无法避免的硬伤，然后把其自身的硬伤和法学本科教育出现的问题结合，论证了学术性法学本科教育是所有法学本科教育问题的根源。最后本文以此根源为切入点，分析了法学教育改革的误区，并提出了法学本科教育定位的建议。 关键词:法学本科教育 学术性倾向 法学本科教育问题的根源 本科教育的定位 The academic undergraduate legal education has inevitable drawback Abstract: As today's increasing development of the Chinese legalization process, legal education also develops rapidly. However, there are problem in the undergraduate legal education itself make the shortcoming more and more outstanding. The legal educationists discuss the countermeasures one after another that are just aimed at the emerged specific issues just like "treating the head when the headaches, treating the foot when the foot hurts", which is lack of deep analysis of the reasons under the questions. First, the paper revealed the issues on the undergraduate legal education by describing the current situation of the undergraduate legal education. Then, instead of being busy with the specific analysis of these issues, we turned our eyes to the undergraduate legal education itself, pointed out the academic tendency of the current undergraduate legal education in many angles, and analyzed and proved that such trend itself has inevitable drawback. Additionally, combine its own drawback with the issues of the undergraduate law education to reason that academic undergraduate legal education is the origin of all kinds of issues of the undergraduate legal education.
